INVESTMENT CONDITIONS SHALL BE APPLIED TO FOREIGN INVESTORS IN VIETNAM

Based on the currently legal documents, it is possible to summarize the conditions that foreign investors need to meet when investing in the Vietnamese market as follows:

- Regarding to the ratio of charter capital owned by foreign investors in a business organization: Foreign investors are allowed to own unlimited charter capital in economic organizations;

- Regarding to the form of investment: establishing a company with foreign investment capital or in the form of capital contribution, share purchase, capital contribution of an established company in Vietnam, a PPP contract or a BCC contract;

- Regarding to the scope of investment activities: Investors shall have an Investment Registration Certificate or Registration of capital contribution, share purchase or capital contribution of foreign investors according to the provisions of the Investment Law;

- Regarding to investment partners in Vietnam: In many business fields when choosing to invest, foreign investors shall be required to enter into a joint venture with a Vietnamese enterprise that has been licensed to operate in that field.
