HOW TO RECORD CONTENTS CONFIRMING CHANGES IN THE CERTIFICATES OF LAND USE RIGHTS UNDER CIRCULAR 09/2021/TT-BTNMT

According to Circular 09/2021/TT-BTNMT, the way of recording the contents of certification of changes in certificates of land use rights, ownership of houses and other properties attached to land (red book) has been updated and applied from September 1, 2021.

- Article 1.4 of Circular No. 09/2021 amending and supplementing Article 18.16 of Circular No.23/2014 (donation of part/whole of land parcels for road, irrigation or other public works) in the following cases:

+ In case the State recovers part of the land parcel to be granted the Certificate;

+ In case the land user donates part of the land parcel on the Certificate issued to a land parcel for making roads, roofing or other public works; In case the land user donates to the entire land parcel.

+ In case the land user donates part of the area of one or several land parcels, donates to a land parcel or some land parcel on the Certificate issued to many land parcels for road, irrigation or other public works.

(Currently, Clause 16, Article 18 of Circular No.23/2014, guiding only how to write in case of voluntary donation of part of the land parcel to make roads, irrigation or other public works).

- Article 1.5 of Circular No.09/2021 supplements the way of recording when a land parcel is separated for issuance of the Certificate separately:

In case on the Certificate issued for many land parcels, there is a land parcel separated for issuance of a separate Certificate, on the issued Certificate it says "Land parcel ... (specify number of parcels, number of maps) area ... m2 is separated for issuance

of certificates separately; according to digital records... (write the registration procedure application code)".
