SUPPORTINH POLICIES THAT WORKERS NEED TO KNOW DURING COVID-19 (Part 1)

In the face of the covid-19 epidemic, which is ongoing in many provinces and cities, workers are one of the subjects facing many difficulties. And to support workers at this time, on July 1, 2021, the Government issued Resolution No. 68/NQ-CP on a number of policies to support workers and employers in difficulty due to the Covid-19 pandemic. At the same time, on July 7, 2021, the Prime Minister issued Decision No. 23/2021/QD-TTg on the implementation of a number of policies to support workers and employers facing difficulties due to the covid-19 pandemic in which, workers are supported with the following 8 specific policies:

1. Policies to support employees to stop working

If the employee is participating in the compulsory social insurance up to the time immediately before stopping the work, he/she is entitled to a one-time support of VND 1,000,000 per person.

Employees need to have the following conditions:

- Working under the labor contract regime (suspended under Clause 3, Article 99, Labor Code).

- Subject to medical isolation or in areas subject to blockade at the request of competent state agencies for 14 days or more.

- The period of medical isolation of employees between May 1, 2021 and December 31, 2021; are participating in compulsory social insurance up to the time immediately before stopping work.

2. Policies to support employees to suspend labor contracts or leave without pay

In Resolution No. 68/NQ-CP, employees who are participating in compulsory social insurance up to the time immediately before the postponement of the performance of labor contracts or unpaid leave are supported once as follows:

From 15 consecutive days or more to less than 01 month the support rate is VND 1,855,000 per person;

From 01 month or more the support level is 3,710,000 VND per person.

Conditions applicable: Applicable to employees working at enterprises, cooperatives, public non-business units that ensure regular expenditures or regular investment and expenditures, private and private educational institutions at the level of early childhood and kindergarten education, primary, middle school, high school and vocational education have been suspended at the request of competent state agencies for COVID-19 prevention and control.

3. Policies to support employees to terminate labor contracts

In case the employee terminates the labor contract due to having to stop operation at the request of the competent state agency to prevent and combat the COVID-19 epidemic and the employee is participating in compulsory social insurance but is not eligible for one-time supported unemployment benefit at VND 3,710,000 per person between May 1, 2021 and December 31, 2021.

4. Additional support policies and children

- Employees at point 1,2,3 who are pregnant are supported by an additional VND 1,000,000 per person; currently raising or caring for children under 06 years of age who are supported by AN ADDITIONAL VND 1,000,000 per child under 06 years of age and only support for 01 person who is a mother or father.

- Children must be treated due to COVID-19 or medical isolation at the discretion of a competent state agency guaranteed by the State budget for treatment and food expenses as prescribed in Point 8, Section II of this Resolution; be supported by the State budget of AN ADDITIONAL VND 1,000,000 per child during the period of treatment and isolation from April 27, 2021 to December 31, 2021.
