Question: Dear Lawyer, my husband is a foreign worker, still using the temporary residence card "LD". In the near future, my husband will quit his job but will continue to stay in Vietnam. Currently, we have registered our marriage for more than 5 months and I am in the name of the apartment. Can I sponsor my husband to apply for a permanent resident card?

According to Article 39 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014, the following cases are considered for permanent residence:
“Article 39. Cases in which grant of permanent residence status is considered
1. Foreigners who have contributed to the development and protection of Vietnam and are awarded medals or titles by Vietnam’s government.
2. Foreigners who are scientists or experts temporarily residing in Vietnam.
3. Any foreigner sponsored by his parent, spouse, or child who is a Vietnamese citizen and has a permanent residence in Vietnam.
4. Any person without nationalities who has had a temporary residence in Vietnam from 2000 or earlier”.
However, in addition, it is necessary to meet the condition of having temporarily resided in Vietnam for 03 consecutive years or more (Article 40 of this Law). Therefore, you need to compare the regulations with your specific case.
Besides, at Point a, Clause 2, Article 5 of Circular 31/2015/TT-BCA, the duration of temporary residence in Vietnam for foreigners applying for permanent residence will be determined on the basis of the entry verification stamp, exit verification stamp issued at the border gate with a total duration of temporary residence in Vietnam of 03 years or more in the last 4 years up to the date of application for permanent residence.
