DOES SHIPPER RECEIVE COVID-19 ASSISTANCE?

Question: Dear Lawyer, I’m a shipper but I don't have an employment contract. Currently, Ho Chi Minh City restricts non-essential shipments so I don't run anymore. Please ask, will I be entitled to assistance due to covid-19?

Answer: Hi! For customer inquiries, Gattaca Law gives advice as follows

Section 12 of Resolution No. 68/NQ-CP 2021 provides for a number of policies to support workers and employers struggling due to the COVID-19 pandemic, including:

"For employees without the conclusion of labor contracts (free labor) and some other specific subjects:

Based on specific conditions and budget capacity of localities, provinces and cities develop criteria, identify subjects and levels of support but the support level is not lower than 1,500,000 VND/people or 50,000 VND/people per day based on the actual number of days of suspension of operation as requested by the locality".

Specifically, the policy of supporting workers without a labor contract (free labor) to lose their jobs due to the impact of the Covid-19 epidemic in Ho Chi Minh City. As prescribed in Clause 4 Article 2 of Resolution No. 09/2021/NQ-HDND of the People's Council of Ho Chi Minh City on June 25, 2021 as follows:

"The employee who has not concluded the labor contract (free labor) legally residing in Ho Chi Minh City (in case of temporary residence must have a temporary residence registration confirmed by the police) has lost his/her job, having no income or income lower than 4,000,000 VND/month (the city's near-poverty standard for the period 2021-2025) doing one of the following six types of work: Street sales, street retail sales; garbage and scrap collection; loading and transporting goods; sale of mobile lottery tickets; self-employment or employment at business households in the field of dining, accommodation, tourism, health care (including security); work in a number of sectors must be suspended under the direction of the City People's Committee in The Dispatch No. 1749/UBND-VX of May 30, 2021. Support level: 50,000 VND/people per day".

Therefore, when the Customer does not sign a labor contract, he/she can enjoy support according to free workers who have difficulties due to the COVID-19 pandemic if they meet the above conditions.
