HOW MAY MUSIC COPYRIGHT INFRINGEMENT BE PENALTED?
Question: Dear Lawyer, I have noticed that in recent years, it is very common for young singers to "plagiarize" music. Is this a violation of the law or not and how will it be punished?
Sincerely thank!
Answer: Hello! With your question, Gattaca Law would like to advise as follows:
Pursuant to Point d, Clause 1, Article 14 of the 2005 Intellectual Property Law (amended and supplemented in 2019) stipulating Types of works which are protected by copyright comprise: literary, artistic and scientific works which are protected by copyright comprise musical works.
Therefore, musical works (songs, remixes, mixes) are subjects that can be registered under copyright and are protected under the provisions of the intellectual property law.
Copying a musical work without permission of the author or the copyright holder for profit is an act of violation of copyright under Clause 6, Article 28 of the 2005 Intellectual Property Law (amended and supplemented 2019). Depending on the nature and level of implementation, the act of copying the work without the author's permission can be administratively sanctioned or examined for penal liability.
