Question: Dear Lawyer, I am the owner of a one-member limited liability company operating in the field of international travel services. Currently, due to the epidemic situation, I want to suppend the company and receive back the deposit at the time of business registration. What do I need to do for a refund of the deposit?

Answer: Hi! Regarding your case, Gattaca Law would like to advise as follows
Request the customer to make the case of enterprise liquidity under the decision of the owner of the limited liability company (Article 207.1.b Law on Enterprises). Thus, the order and procedures for requesting the refund of deposits for travel service enterprises guided by Circular No. 06/2017/TT-BVHTTDL detailing a number of provisions of the Law on Tourism will include the following steps:
Step 1: Enterprises send dossiers of request for termination of DVLH business activities
Document:
- Notice of termination of travel service business;
- License for travel service business has been granted;
- Dissolution decision of the company owner.
Within 05 working days since receipt of a valid application, the licensing authority shall issue a decision on revocation of the license for provision of travel services. The decision on revocation of the license shall be issued to the provider, immigration authority, tax authority and business registration authority of the province where the provider’s headquarters is located, and published on the web portal of the licensing authority and travel service provider management website.
Step 2: Refund the deposit after revoking the license for travel services
After 60 days from the day on which the decision on revocation of the license for provision of travel services is published on the web portal of the licensing authority and travel service provider management website, in case of no complaints and denunciations related to obligations towards tourists or tourism service providers, the licensing authority shall request banks to let the travel service provider to withdraw its deposits.
In case of complaints and denunciations related to obligations towards tourists or tourism service providers, the licensing authority shall cooperate with relevant competent authorities in taking actions in accordance with regulations of law.
